Welcome to Zameenza. These Terms of Service govern your access to and use of our website, property listing system, seller tools, buyer inquiry forms, lead management systems, analytics, installment plan presentation, media galleries, communication features, WhatsApp integrations and any related services provided under the Zameenza platform.
1. Acceptance of Terms
By accessing, browsing, registering, listing a property, sending an inquiry, uploading media, submitting contact details, viewing property information or using any service of Zameenza, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must immediately stop using the platform.
2. Eligibility
- You must be at least 18 years of age to use the platform.
- You must have the legal capacity to enter into binding agreements.
- If you use the platform on behalf of a business, agency, developer or company, you confirm that you are authorized to act on its behalf.
- You must not use the platform if your use is prohibited by applicable law.
3. Accounts & Registration
- You are responsible for maintaining confidentiality of your login credentials.
- You must provide accurate, complete and updated account information.
- Fake accounts, impersonation, misuse of seller profiles or unauthorized access are strictly prohibited.
- Zameenza may suspend, restrict or delete accounts involved in fraud, spam, suspicious conduct or policy violations.
4. Platform Services
Zameenza provides a digital real estate platform for property discovery, listing, buyer-seller communication, property presentation, inquiry capture, analytics and related services. The platform is not a real estate owner, buyer, seller, legal advisor, valuation authority, financing institution or government verification body unless expressly stated.
5. Property Listings & Content
- Listing owners are responsible for accuracy of property title, price, size, location, images, videos, installment plans and availability.
- All property details are provided for information and marketing purposes only.
- Prices, availability, possession, dues, legal status and transfer conditions must be independently verified by the user before any transaction.
- Zameenza may remove, edit, de-rank or disable listings that are inaccurate, duplicated, misleading, illegal or reported by users.
6. Property Verification
Any verification badge, premium label, featured tag or promoted placement does not guarantee ownership, legal title, transferability, government approval, NOC status, tax clearance, possession status or absence of disputes. Users must conduct their own legal, technical, financial and physical due diligence.
7. Leads & Communications
- Inquiry forms, WhatsApp buttons, contact forms and advisor requests are designed to connect interested parties.
- Zameenza does not guarantee that any inquiry will result in a deal, response, visit or transaction.
- Users must not misuse lead information, spam other users, scrape contact data or resell buyer/seller leads.
- Communication between users may be recorded or stored for service, quality, security and follow-up purposes.
8. Seller, Agent & Developer Responsibilities
- Sellers must only list properties they are legally authorized to market.
- Sellers must disclose material facts including litigation, possession issues, pending dues, transfer restrictions or installment obligations.
- Sellers must ensure media and documents uploaded are genuine and legally usable.
- Misrepresentation, fake prices, false urgency or deceptive advertising may result in account termination.
9. Buyer, Investor & Tenant Responsibilities
- Buyers must verify ownership, title documents, society approval, map approval, taxes, dues and transfer requirements.
- Users should inspect properties physically before making payments or commitments.
- Zameenza is not responsible for private negotiations, token payments, advance payments or side agreements.
- Investment returns, future values and price forecasts are estimates and not guaranteed.
10. Payments & Transactions
Any platform fees, listing promotions, subscriptions, featured placement, lead credits or service charges may be subject to separate pricing. Unless expressly stated or legally required, paid platform fees are non-refundable. Property sale or rent payments should only be made after proper legal verification.
11. Installment Plans
- Installment schedules are provided by sellers, developers or listing owners.
- Zameenza is not a bank, lender, finance company or guarantor of installment plans.
- Installment amounts, due dates, penalties, possession dates and documentation must be verified from official records.
- Displayed installment calculators are for convenience and may not reflect final contractual terms.
12. Media Uploads, Videos & Documents
- Users uploading images, videos, brochures, maps or PDFs must have legal rights to use them.
- Uploaded files must not contain malware, illegal content, copyrighted material without permission or misleading visuals.
- Zameenza may compress, display, crop, watermark, remove or moderate media for platform safety and performance.
13. Analytics, Reports & Forecasts
The platform may display property views, lead counts, price forecasts, investment insights, search trends and analytics. These are informational indicators only and should not be treated as financial, legal or investment advice. Users must seek professional advice before making major financial decisions.
14. Intellectual Property
- Zameenza branding, design, software, layout, databases, content structure and platform features are protected intellectual property.
- You may not copy, scrape, reverse engineer, reproduce or commercially exploit the platform without written permission.
- By uploading content, you grant Zameenza a limited license to host, display, promote and distribute that content for platform operations.
15. Prohibited Uses
- Posting fake, illegal, disputed or misleading property listings.
- Fraud, impersonation, harassment, spam, scraping, hacking or unauthorized access.
- Uploading viruses, malware, harmful scripts or abusive automated tools.
- Using the platform for money laundering, illegal transfers, tax evasion or unlawful transactions.
- Misusing buyer, seller, agent or developer contact information.
16. Third-Party Links & Services
The platform may contain links to WhatsApp, Google Maps, YouTube, social media, payment gateways or third-party websites. Zameenza is not responsible for third-party content, availability, policies, security, accuracy or actions.
17. Privacy & Data Use
By using the platform, you agree that your submitted details, inquiries, messages, device data, IP address and usage behavior may be collected and processed according to our Privacy Policy. Users should review the Privacy Policy for details regarding data collection, storage and usage.
18. Disclaimers
The platform is provided on an “as is” and “as available” basis. Zameenza does not guarantee uninterrupted service, error-free operation, accuracy of listings, completion of deals, investment profit, legal validity of properties, seller authenticity or transaction outcomes.
19. Limitation of Liability
To the maximum extent permitted by law, Zameenza, its owners, employees, developers, partners and affiliates shall not be liable for indirect, incidental, special, punitive or consequential damages, loss of profit, failed deals, incorrect listings, user disputes or third-party misconduct.
20. Indemnity
You agree to indemnify and hold harmless Zameenza, its owners, officers, employees, contractors and partners from any claims, losses, damages, liabilities, penalties or expenses arising from your misuse of the platform, violation of these Terms, illegal content, false listing information or disputes with other users.
21. Suspension & Termination
Zameenza may suspend or terminate any account, listing, inquiry access or platform feature without prior notice if we detect fraud, policy violation, abuse, security risk, unlawful activity or conduct harmful to platform integrity.
22. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the Islamic Republic of Pakistan. Courts located in Punjab, Pakistan shall have jurisdiction where applicable. Parties should first attempt good-faith resolution before initiating formal legal proceedings.
23. Changes to Terms
Zameenza may update, revise or replace these Terms at any time. Updated Terms will be posted on this page. Continued use of the platform after updates means you accept the revised Terms.
